TERMS & CONDITIONS

1. Terms and Conditions of Custom Orders

In these terms "Client" or "Buyer" shall mean the person whose name and details appear on the estimate.

The Client shall be treated as commercial or domestic according to our reasonable discretion.

All quotations are given and all orders are accepted on these terms. They supersede any other terms appearing on our price list or elsewhere, and override and exclude any other terms stipulated or interpreted or referred to by the Client, whether in the instructions or any negotiations or any course dealings established between Smith Paisley Designs and the Client. All orders/instructions given by the Client shall be deemed to be made subject to these terms.

All goods supplied by Smith Paisley Designs are supplied subject to the following terms and conditions:

All our quotations for custom work are subject to the relevant pieces(s) being in the condition as presented; and may need adjusting on closer inspection or once preliminary work begins; and a slightly different end-view may need to be accommodated.

Quotations are valid for a period of 30 days from written quotation.

Acceptance of work to be carried out is deemed to be when an order is confirmed by the Client, either verbally or in writing.

2. Collection/Shipping

Because the Smith Paisley Designs does not deliver or arrange shipping this charge is not included in the price of the estimate/quote. Due to the special nature of the completed pieces, more specialised packaging and delivery is required. We are happy to suggest a suitable courier; please see the Shipping/Collection on our website. Once payment for the item(s) has been made, the Client may wish to take receipt of the item(s) in person, or by their appointed courier by prior appointment only, from Smith Paisley Design’s studio. Items supplied for customisation will need to be transported by the Client or their courier, both to and from the design studio. Because there are no storage facilities, Smith Paisley Design’s requires the piece to arrive as close to the day as possible when work is due to start on it. And be collected within 7 working days of completion. If by courier or anyone other than the Client, Smith Paisley Designs will release the item by the Client’s prior authorisation only.

3. Payment

A 50% non-refundable deposit payment is due on acceptance of an order unless otherwise stated or agreed upon.

Title of goods will only pass to the Client on receipt of full monies on that order, which is due on completion of work and before it can be collected. Smith Paisley Designs reserves the right to charge interest on overdue accounts at 8% over bank minimal rate for the time those monies are outstanding. And if the outstanding amount is not paid, the uncollected item will be held for 30 days. At the end of 30 days, items not paid in full on completion and which remain uncollected will become the property of Smith Paisley Designs/or incur storage fees depending on the circumstances.  

All estimates or quotations unless otherwise stated will be ex works.

Smith Paisley Designs will be released from any liability to the Buyer if performance of the agreement is delayed or prevented by any cause whatsoever beyond our control.

4. Modifications

Be advised: Artwork revisions or amendments are limited to minor colour changes and/or small details. They are not a complete change to the original agreement.

Major changes will not be done once the piece is complete. However, once the work is underway if at any time the job changes to an extent that substantially alters the specifications as described in the original estimate, a new order will be drawn up to reflect the new custom artwork requested and will invoke additional design fees based on the scope of the project. We will submit a new proposal to you and a revised fee will be agreed upon by both the Client and Smith Paisley Designs before moving forward with the project.

Smith Paisley Designs will not be held responsible for the Client’s mistaken/or wrong colour, finish, or design choices.

Please note that the more changes that are made, the longer the completion date will be pushed back.

5. Care Instructions

Please see the general care instructions for our artwork; should your order need additional more specific instruction they will be provided.

6. Copyright

Smith Paisley Designs owns all copyrights in any and all work(s) created or produced pursuant to federal copyright law under the UK Copyright, Designs and Patents Act 1988 and extended to overseas, whether registered or unregistered.

7. Cancellations

Should the Client wish to cancel an order before work has commenced, their deposit will be forfeited, and they will be required to arrange for collection of the piece within 7 working days. Failure to do so within 30 days will result in the piece(s) becoming the property of Smith Paisley Designs.

Once an order has been placed by the Client and work begun on a piece, it cannot be cancelled nor products returned for credit, and full payment will still be required.

Any goods already completed to Client specifications or clearly personalised are excluded from the right to cancel.  These are bespoke items, created specifically to order and are therefore non-returnable (to Smith Paisley Designs). And non-refundable.

Should there be an agreement for an urgent contract for services that start right away, the Client will be required to expressly waive their cancellation rights.

8. Disputes

Any disputes arising between the  and Client and Smith Paisley Designs under these terms and conditions shall be determined under English law.
